Parents must have an exemption for vlogs showing their children

What changes? 

Do you make vlogs or video’s in which your child regularly appears ánd do you make money from this? If so, you will have to keep to stricter rules. The government wants to offer children better protection from the risks of online work. The rules will apply to vlogging families, and kidfluencers and child vloggers and their parents. 

The changes are: 

  • You need to apply for dispensation if your child appears in vlogs that generate income. For example, vlogs on YouTube, TikTok, or Instagram.
  • As the parent you are considered the employer. This means you can be held responsible if the rules are not complied with.
  • The NL Labour Authority will have more powers to check this. A mandatory dispensation makes it easier for the inspectorate to check whether you keep to the rules.
  • The fines for violating the rules will be higher, especially if the child experiences commercial pressure.
  • Parents will receive more information on the risks of online visibility for their children and about the rules that apply.

For whom? 

  • parents that make vlogs in which their child appears
  • vlogging families that earn money with their online videos
  • companies or brands that work together with child vloggers 

When? 

It is not yet known when this change in the Working Conditions Acts (Arbeidsomstandighedenwet) will take effect.

Please note: The effective date of this measure is not yet final. Entry into force is subject to its passing through the Lower and Upper Houses (Tweede en Eerste Kamer) of parliament. After publication in the Staatsblad or Staatscourant (Government Gazette, in Dutch) the law can take effect.
