If you are going to rebuild or demolish, you usually need an environmental permit. The environment permit gives permission for work on housing, space, environment and nature. You do not always need an environmental permit. Want to know whether you need to apply for a permit? Then do the permit check at omgevingsloket online. There is a check for private individuals and for companies.

Examples of environmental permit activities:

  • Felling a protected tree
  • Constructing a driveway or service road
  • Building a structure
  • Demolishing a structure
  • Setting up or changing an establishment (environment)
  • Altering a municipal or national monument
  • Advertising

Do you doubt the feasibility of your plan? If you have the sketch plan assessed by the Building Regulations Committee, you can check its feasibility. Via the online environment desk, you can digitally request a sketch plan and building regulations advice.

Apply for an environment permit

You first apply for the single permit at omgevingsloket. On that website, you will find detailed information about the single permit and get help with your application. Your online file shows the status of your application.

You can also submit your application in writing. Compile a paper application form at the environment desk online, print it out and send the completed form (including attachments) in duplicate to the municipality. Send this to the postal address below.

Tree felling

You can look up which trees are protected on the Tree Map. Is the tree on the tree map? Then you are not allowed to fell it without a permit. In the areas with special tree value (shading) this prohibition applies to all trees. Are you not the owner of the tree? Then you also need a written authorisation from the owner. Sometimes other regulations apply, such as a zoning plan, the Forest Act or the Nature Protection Act. These stipulate, among other things, that trees may not be felled if bats or nesting birds live there.

Demolition

When you need to submit a demolition notification follows from the Building Decree. This is the case, for example, if more than 10 m³ of demolition waste is released or if asbestos is involved. You submit the notification via the Omgevingsloket online. The notification is only legally valid if it is complete and submitted in accordance with the requirements. This must be done at least 4 weeks before demolition work starts. Sometimes this is allowed up to at least 5 days before commencement. In urgent cases, the municipality may decide that the notification period does not apply.  

Monument

If you are going to restore, rebuild or (partially) demolish a municipal or national monument, you usually need an environmental permit. You apply for the single permit digitally at Omgevingsloket Online. This requires: a situation sketch, floor plans and facade views, both of the current and the desired situation. The Municipal Executive decides on this permit.

Permits submitted and granted

In 2021, an information page of the municipality appears every Thursday in weekly newspaper De Loop. This contains the permit applications and grants. From the date of dispatch of the permit, you can view them.

Inspection of permits that are not yet irrevocable is free of charge. When permits are irrevocable, you pay a fee for inspection.

Consult building plans and drawings

You can request building plans and drawings of existing and new buildings from the municipality. If you want to see these or request copies, there is a charge for this.

The BIBOB Act prevents us from unwittingly facilitating criminal activities by granting a permit. To do this, you can download the form ‘Bibob questionnaire Construction (Helmond)‘, in Dutch. Make sure you have first applied for your environmental permit at omgevingsloket.

The cost of an application depends on the activity(ies) you are applying for. You pay per activity for which you apply for a permit.The fees are listed in the fees table of the fees regulation.

Standard procedure: you get the decision within 8 weeks. The municipality can extend this period once by 6 weeks.

Extended procedure: you receive the decision within 6 months.The municipality may extend this period by 6 weeks.

Is your application incomplete? Then you will be given the opportunity to supplement the application. The time you need to do this is added to the decision period.

The permit must take effect before you can start work. This is usually one day after publication, but sometimes it takes longer. The permit is not final until the period for submitting a notice of objection or appeal has expired unused or a decision has been made on a submitted notice of objection or appeal. Do you start working with a permit that is not yet final? If so, you are responsible for any consequences.

In an ordinary procedure, you lodge an objection with the municipality. In an extensive procedure, you give your opinion (view) on the draft decision.

Do this within 6 weeks.

Do you disagree afterwards? Then you can lodge an appeal with the court. If necessary, you can appeal afterwards.

No response within the six-week appeal period? Then the permit is final.
