You are going to refurbish your house or you are going to build a new driveway on your plot. Since 1 October 2010, you require a permit under the Dutch Environment and Planning Act for this.This permit replaces many permits in the area of living, space, environment, and nature. Assume you require multiple consents, then the permit under the Dutch Environment and Planning Act suffices. It can be applied for at one service counter. One procedure applies after which one decision follows. To appeal against this decision, there is only one appeal procedure left.

  1. Go to Omgevingsloket online (the online environment service counter, in Dutch).
  2. Run a permit check to see if you need a permit or if you must submit a notification.
  3. If you need a permit, you can apply for it at once online on Omgevingsloket or send in a written application. Log in with DigiD (for individuals) or eHerkenning (for businesses).
  4. If you have to submit a notification, you can do so at once on Omgevingsloket. Log in with DigiD (for individeuals) or eHerkenning (for businesses).

A permit under the Dutch Environment and Planning Act may have adverse consequences for nature. Namely, the conservation of protected areas, flora and fauna species may be jeopardised. Clearly indicate this in the application.

Prior consultationTo gain insight into the feasibility of a future (building) plan, you can apply for a prior consultation. You then know, before you elaborate the (building) plan in detail, whether a permit under the Dutch Environment and Planning Act can be granted for the plan. You receive a written reply to your request. Download the form.

The cost depends on which all-in-one permit for physical aspects you apply for. Note that you must pay even if your application is rejected .

The municipality will need 8 weeks (standard procedure) to assess your application. It will sometimes take 26 weeks (extended procedure). This will be the case, for example, if you want something different from what is stated in the bestemmingsplan (zoning plan). The municipality can extend the period once for a period of 6 weeks.

Do you want to object? In this case, the following rules apply.

  • For a standard all-in-one permit for physical aspects (8 weeks), you can file an objection within 6 weeks of the decision being published. How to do this is stated in the published decisions.
  • Does it concern an extended all-in-one permit for physical aspects (26 weeks)? Then it is issued a a draft decision. You can submit your opinion within 6 weeks. After that, a final decision will be made.. You can appeal to the district court within 6 weeks. You can send your letter to: [adres].

Good to know

You must not start work until you have obtained the permit. If you start before that, you may have to undo the work at your own expense.
