The procedure is as follows. A new zoning plan starts with making a design available for inspection for six weeks. A publication appears in the MooiLaarbeekKrant and the Staatscourant. Within the six weeks that this is available for inspection, everyone has the opportunity to submit a view to the city council. An opinion means that you are allowed to think something of it. That you see it differently than what we have come up with. The zoning plan is then submitted to the municipal council through consideration in the Spatial Domain Committee. The City Council is then asked to record it. After adoption by the city council, the zoning plan will again be made available for inspection for six weeks. Within that period there is the possibility to lodge an appeal with the Administrative Jurisdiction Division of the Council of State.
A zoning plan consists of:
-one or more images (map on which the destination is indicated)-rules on building and use-an explanation-any appendices such as a noise report or a soil investigation.
In a zoning plan you will find, among other things:-building regulations, for example: the type of building that is allowed the way to build the maximum height and width of buildings rules about use for what purpose the buildings and the land may be used.
Everyone is bound by the zoning plan: not only the citizens, companies and institutions, but also the municipality itself.
View zoning plan.
You can view the zoning plans of the municipality. This is useful, for example, if you have building plans or want to start a business. The zoning plans can be viewed via www.ruimtelijkeplannen.nl. It is also possible to view the zoning plan at the town hall.
Change zoning plan
Do you want to develop a plan that deviates from the zoning plan? Then submit a request to the municipal executive to change the zoning plan. The Board assesses whether the request is in line with its policy. If that is the case, the Board will ask you to substantiate your request in more detail. We call this a spatial substantiation. After the Commission has approved the substantiation, agreements will be concluded with you about the (financial) consequences of the development. The zoning plan procedure can then be started. Any interested party may request the municipal council to amend a municipal zoning plan. Minor changes to the zoning plan can also be implemented by the mayor and aldermen.
You owe an amount on the basis of the fees ordinance for drawing up and submitting a zoning plan. You will find this amount in Verordening op de heffing en de invordering van leges 2024 | Lokale wet- en regelgeving (overheid.nl)
It will take at least 6 weeks to deal with your claim/application, but it can also take over 1 year.
