The Environmental Act came into effect on January 1, 2024. From that moment on, we have 1 temporary environmental plan for the entire municipality. The environmental plan states how you may use land and buildings. For example, where homes or businesses are allowed.

The transition phase of the environmental plan

When the Environmental Act comes into effect, the municipality automatically has 1 temporary environmental plan: an environmental plan by operation of law. This environmental plan contains all (old) zoning plans and a number of rules that the government transfers to us. It is up to us to make all this information in the environmental plan increasingly accessible. We do this by gradually changing the environmental plan. This transition phase will last until 2032.

You can view the environmental plan at the Environmental Desk. Via the ‘Rules on the map’ section you can see which rules apply at your location. Here you will find the former zoning plan as a temporary environmental plan in the transition phase. You can also do a permit check at the Environment Desk to see whether you need a permit or, for example, need to make a report.

Environmental plan

Your plans for, for example, construction or use of your plot may not fit within the municipal environmental plan. This does not necessarily mean that you cannot realize your plan. We have included in policy what desired developments are and what principles apply to them. Whether you can make your plans possible based on this municipal policy requires additional consideration.

We would be happy to discuss with you whether and how you can realize your initiative. We do this step by step, whereby we consider the desirability of your initiative at each step.

1. Environmental consultation

The first step in the process is the environmental consultation. You can submit a request for an environmental consultation to the municipality via the Environment Desk. You log in with DigiD or eHerkenning. Start a request and follow the steps of the request. Choose the activity ‘deviation from the environmental plan’ and add a description of your plan and (if necessary) a situation drawing. In the last step of submitting an application, choose the ‘draft request (environmental consultation)’ option.

During the environmental consultation, we make an initial assessment of the desirability and feasibility of your initiative. If it is estimated that your initiative is desirable and feasible, you will receive a response with the next steps, any comments, the proposed procedure (amendment of the environmental plan or permit for extra-plan environmental plan activity) and the preconditions. Starting a participation process is one of the next steps.

Submitting a draft request for an environmental consultation costs €270.

Participation

We believe it is important that you involve your neighbors and any other stakeholders in your initiative at an early stage. That is why we ask you to start a participation process. You can use the step-by-step participation plan for this. This step-by-step plan guides you through the various participation components from preparation to implementation of participation. The final actions taken in the participation process and the results thereof are recorded in a participation report. This participation report is part of the assessment of your request in principle.

2. Request in principle

After completing the environmental consultation, you submit your (adjusted or supplemented) plan with the participation report as a request in principle to your contact person within the municipality.

We will submit your request together with advice to the mayor and aldermen. In the event of a positive decision in principle by the council, the council will submit your request to the territory committee. The territory committee will then provide an opinion on the desirability and feasibility of your request. The council’s decision in principle and the opinion of the territory committee must be seen as a statement and not a decision: the council and committee express a positive or negative attitude towards your initiative. If the territory committee receives a positive opinion, including any additions, preparation for your final permit application or environmental plan amendment procedure can start.

3. Preparation of final permit application or environmental plan amendment procedure

This step results in a permit application for an extra-plan environmental plan activity or the amendment of the environmental plan. This means that you must have various investigations carried out and that you must prepare the plan in accordance with the applicable requirements. Various specialists look into this and provide advice. A distinction is made between what is necessary to develop the plan and make it feasible and what may be desirable to make the initiative even better.

4. Final permit application or submission of documents for changes to the environmental plan

When the previous steps have been completed successfully, you can submit the final environmental permit application or final documents. A permit application for an extra-plan environmental plan activity can be submitted via the Environment Desk. You must submit the documents for amending the environmental plan to your contact person at the municipality.

The fees for the entire preparation phase from environmental consultation to preparation of the final application and documents are € 270.

You pay fees for amending the environmental plan or the permit application for an extra-plan environmental plan activity. You can find this in the regulations on government.nl. You also pay the costs of the consultancy firm, associated investigations or for providing the necessary documents yourself. Your contact person within the municipality will inform you about the costs during the process.

There is no fixed period for the preparation phase of your plan. The preparation phase for, for example, a large infill location generally takes longer than the preparation phase for the construction of 1 home. We believe it is important to go through this preparation phase carefully. This ensures that the final application or plan change can be processed within the legal period.
