Damage caused by a zoning plan
Plan damage
If we change the zoning plan, you may be affected. For example, because a block of flats may suddenly be built next to your house. You can then sell your home for less money than before. This is called planning damage.
Do you think you suffer as a result of a change in the zoning plan or a similar spatial plan? Then you can ask us for compensation. You can sometimes recover part of the damage. There is always an excess if:
- your income decreases due to the change
- your property becomes worth less due to the change
There are a few conditions. For example:
- You could not have known in advance that you would suffer damage when you bought the house or land.
- You will not get any other compensation for the damage.
Apply for it on time. At least within 5 years after the spatial plan has become final. Among other things, state why you are asking for compensation. Note that the whole application period can take a few years. If you do not agree with our decision afterwards, you may object.
It will take at least 6 weeks to deal with your claim/application. In most cases, external advice must be sought by the municipality and then the procedure can take much longer.
