Damage caused by an environmental and land-use plan
A decision made by the municipality regarding the physical environment may cause you damage or financial loss. For instance, when a municipality includes activities that are directly allowed in the environmental and land-use plan. Or when the municipality grants an environmental or spatial permit in deviation from the environmental and land-use plan. You can claim compensation if you suffer damages. To claim compensation, you must wait until the municipality’s decision is final. It is final when it is no longer open to objection or appeal.
There are some important criteria to qualify for compensation for damage caused by decisions (vergoeding nadeelcompensatie):
- You could not have foreseen the damage when you bought the building or the land;
- You did not receive any other compensation, for instance for expropriation (onteigening);
- You cannot submit a request for damage (nadeelcompensatie) against (development) possibilities in the environmental and land-use plan. You can submit a request for compensation against a decision that is taken based on these possibilities.
- You cannot submit a request for damage (nadeelcompensatie) against possible use of general rules in the environmental and land-use plan. You can submit a request for compensation when a person or company is using these general rules to perform an activity.
Applying for compensation
You can claim compensation from the municipality by writing to Postbus 950, 6000 AZ Weert, addressing the college of B&W.
The letter must include:
- your name, address, and signature
- the reasons and supporting arguments for the compensation
- the measure causing the damage
- a description of the damage
- the date
- in the event of damage to immovable property: whether you are a tenant or the owner
- all supporting documents in your possession

In principle a decision will be reached within 8 weeks. In nearly all cases an advisory committee advise on the request for prudent decision-making, increasing the decision time to 6 months, but it can also take over 1 year.
