Municipality Elburg: Environment and planning permit for environmentally harmful activities
Companies that place a heavy burden on the environment require an environmental permit for the environment. You may need this if, for example, your company:
- consumes a lot of energy
- pollutes the air
- causes noise nuisance
- caused odor nuisance
You have the following 2 choices:
- You can apply for a nature conservation permit or exemption from the province. The province only assesses the consequences for nature. The province may set special requirements, such as ecological guidance. You then apply for an environmental permit from the municipality. In that case, the municipality does not assess the consequences for nature.
- You apply for an environmental permit from the municipality. You will also be asked to carry out a nature test. This means that the municipality also assesses the consequences for nature. To this end, the municipality asks the province for a statement of no objections (vvgb). The municipality will include the DNO in the decision on your application. Does the province refuse to issue the vvgb? Then the municipality will reject your permit application.
The condition for applying for an environmental permit for the environment is that your company has a heavy burden on the environment. For example:
- sewage treatment plants with a sludge digester
- car demolition companies that also break trucks
- farms that use a propane tank

You must submit the environmental management notification online via the AIM (in Dutch).
All-in-one permit for physical aspects (environmental permit)
If you start, change, or expand a business, you must apply for an environmental permit from the Online environment portal:
- Log in with DigiD (for individuals) or eHerkenning (for businesses).
- Do the permit check.
- You can then immediately apply for the permit.
- Depending on the type of company and how big it is, please provide:
- an acoustic report
- a soil survey report
- an odor report
- an energy report
- a map
- a business plan in which you explain the business activities.

All-in-one permit for physical aspects (environmental permit)
The costs depend on which permit you apply for. You must pay even if you do not get the permit. See the fee regulation for this.
The municipality will need 8 weeks (standard procedure) to assess your application. Sometimes it can take 26 weeks (extended procedure), for example if you want to deviate from the zoning plan. The municipality can extend the period once by 6 weeks.
If you want to object, the following applies.
- For a standard all-in-one permit for physical aspects (8 weeks), you must file an objection within 6 weeks after the decision is published. How to do this is stated in the published decision.
- Does it concern an extended all-in-one permit for physical aspects (26 weeks)? Then it is issued as a draft decision. You can submit your opinion within 6 weeks. After that, a final decision will be made. You can appeal to the district court within 6 weeks. After that, there is the possibility of appeal to the Administrative Jurisdiction Division of the Council of State. Was there no response within the appeal period of 6 weeks? Then the permit is final.
