Municipality Goeree-Overflakkee: Environment and planning permit for environmentally harmful activities

Description
Companies that place a heavy burden on the environment require an environmental permit. You may need this if, for example, your business:
- consumes a lot of energy
- pollutes the air
- caused noise nuisance
- odor nuisance caused
Some companies do not have a license and notification obligation. These include offices, various healthcare institutions, GP practices and playgroups.
Sometimes you apply for a permit from the province or make a report there. This usually concerns larger companies, such as chemical factories. Would you like to know more about this? Then contact the province.
The environmental permit can have disadvantages for nature. This is because the conservation of protected areas, plant or animal species may be at risk. Please indicate this clearly in the application. You then have the following choice:
- You apply for a nature conservation permit or exemption from the province. The province only assesses the consequences for nature. The province can set special requirements, such as ecological guidance. Then you apply for an environmental permit from the municipality. In that case, the municipality does not assess the consequences for nature.
- You apply for an environmental permit from the municipality. You will also be asked to perform a nature test. This means that the municipality also assesses the consequences for nature. For this, the municipality asks the province for a declaration of no objections (DNO). The municipality will include the DNO in the decision on your application. Does the province refuse to issue the DNO? Then the municipality will reject your permit application.
The condition for applying for an environmental permit is that your company places a heavy burden on the environment. For example:
- sewage treatment plants with a sludge digestion plant
- car wrecking companies that also wreck trucks
- farms that use a propane tank

- You can apply for the permit immediately afterwards.

- Depending on the type of business and how large it is, pass on:
- an acoustic report
- a soil investigation report
- an odor report
- an energy report
- a map
- a business plan in which you explain the business activities
When you apply for an environmental permit, you usually do not only pay the costs for the environmental permit. Often the municipality also charges planning costs. These are costs for preparing and supervising the construction of facilities. For example, green areas, new roads or the filling of ditches. There is a national calculation model (link is external) with which the municipality determines the planning costs.
The application and the draft permit are published and made available for inspection for 6 weeks. During this period, interested parties can respond in writing or orally. After the inspection period, the application and the final permit will be published and made available for inspection for another 6 weeks
Are you the applicant or have you responded to the application and design permit? Then you can appeal to the court. If necessary, you can still appeal (link is external).
Was there no response within the appeal period of 6 weeks? Then the permit is final.
