An environmental permit is a decision by the municipality (or another government body) whereby an applicant is given permission to do something that is normally prohibited under the Environmental Law General Provisions Act. Regulations are attached to an environmental permit in the interest of protecting the environment. If you act without an environmental permit or in violation of the permit, this is punishable by law. 

The Haaglanden Environment Agency is responsible on behalf of the municipality of Midden-Delfland for carrying out the statutory environmental tasks for the Haaglanden region. The environmental service handles environmental reports and complaints, supervises and arranges environmental permits for the entire Haaglanden region. In the case of multiple permits, such as a building permit with an environmental element, the environmental service prepares the environmental part.

Make the notification or apply for the environmental permit for the environmental activities before carrying out the activity. This will prevent you from being in violation. You can check whether you need to make a notification or need a permit via the Activities Decree Internet Module (AIM). In most cases, your company can suffice by submitting a notification via the AIM. If you have an agricultural company, then in most cases a notification in accordance with the Agricultural Environmental Management Decree (hereinafter: Agriculture Decree) will suffice.

Notification of environmental activity

  • Submit the notification via the Online Environment Desk or the Activities Decree Internet module. Once you have answered all the questions, you will be taken to a summary screen where you can download the prescription package that applies to you. 
  • The Haaglanden Environment Agency and/or the municipality of Midden-Delfland will assess the report for completeness and may ask you for additional information. 
  • The notification is published in the electronic municipal magazine and in De Schakel Midden-Delfland.
  • You must submit a notification at least four weeks before you carry out the intended activities.

Apply for an environmental permit

Submit your application for an environmental permit via the Environment Desk online. You need eHerkenning for this. After one to three days you will receive your eHerkenning token and you can log in to the government organization with which you want to do business digitally. Then complete the application form via the environmental counter with the required documents. You will then receive a confirmation of receipt. This states the procedure to be followed. After the competent authority has made a decision, you will automatically be notified whether you will receive the permit.

All-in-one permit for physical aspects (environmental permit)

The costs depend on which permit you apply for. You must pay even if you do not get the permit.

  • After receiving your application for an environmental permit, the municipality will decide within 8 weeks. This period can be extended by 6 weeks. This is the short (regular) procedure. 
  • A decision period of 26 weeks applies to complex applications. This period can also be extended once by 6 weeks. This is the extended procedure. 
  • An environmental permit with the environmental component is always a complex application with a decision period of 26 weeks.

Make an objection or submit a view

Whether you can object or submit a view depends on the procedure followed. The publication of the announcement states to whom you should address your objection or opinion. In the short procedure, you as an interested party can lodge an objection with the municipality of Midden-Delfland if you do not agree with the decision on your permit application. Submit your objection within 6 weeks after the announcement of the decision. After handling this objection, you may appeal to the court. In the extended procedure, a draft of the decision on your permit application is first drawn up. The municipality makes the draft decision on the environmental permit available for inspection. Anyone can submit their view on this within 6 weeks after it has been made available for inspection. Explain in your opinion why you disagree with the decision. These views will be taken into account in the final decision. You may appeal against this to the court. 

After the decision has been taken, interested parties can appeal to the court within 6 weeks after notification. In the case of the extended permit procedure, interested parties can only appeal if they have also submitted a view on the draft permit in a timely manner or demonstrate that they were not reasonably able to do so. There may be several interested parties who can appeal to the court.

Do you disagree with the court’s ruling? You can then appeal to the Administrative Jurisdiction Division of the Council of State.
