Buildings must meet fire safety regulations.

In some cases, you must notify the municipality that you are going to use the building; this is called a notification of fire safety-compliant use (gebruiksmelding brandveilig gebruik) .

You must apply for an all-in-one permit for physical aspects (omgevingsvergunning) for fire safety-compliant use.

You can find out if you need to make a notification by running the permit check on the online service counter Omgevingsloket online (in Dutch).

You must apply for an environmental permit for fire-safe use if you:

  • Night accommodation is provided to more than 5 persons commercially or in the context of care (for example nursing homes and hotels);
  • Day care will be provided to more than 10 children under the age of 12, or to more than 10 physically and/or mentally disabled persons (for example day care centers and primary schools).

Usage Notification

For some buildings, reporting is sufficient. This is the case for buildings in which more than 50 people stay (and where people do not sleep). A notification must also be submitted when a residential function is taken into use for room-by-room rental and if an equivalent solution is applied to a regulation referred to in chapter 6 or 7 of the 2012 Building Decree with regard to fire safety.

  • You must submit the same documents as with the permit;
  • You do not have to pay any fees;
  • You must submit the notification of use four weeks before use.

Procedure

Here the extensive preparation procedure applies. This procedure has a lead time of six months with a possible extension of six weeks.

  1. During this procedure, the permit will first be made available for inspection in draft form for six weeks;
  2. You, but also others, then have the opportunity to express your opinion to the competent authority;
  3. The opinions are included in the final permit, which can then be appealed to the administrative court.

You must submit the notification of use four weeks before use.

The requirements for issuing an environmental permit or a notification differ per establishment. This also applies to the information about the furnishing that you must submit. The competent authority will indicate what documents you need to bring or send.

Applying or submitting a notification

  1. Go to the online service counter Omgevingsloket online (in Dutch).
  2. Run a permit check to see if you need a permit or if you must submit a notification.
  3. If you need a permit, you can apply for it at once online on the online service counter Omgevingsloket or send in a written application. Log in with DigiD (for individuals) or eHerkenning (for businesses).
  4. If you have to submit a notification, you can do so at once via the online service counter Omgevingsloket. Log in with DigiD (for individuals) or eHerkenning (for businesses).
  5. You will receive a written answer from the competent authority. This can be the municipality, but also the province, the water board or the central government;
  6. Consultation with the competent authority is usually necessary: ​​an environmental permit requires customization;
  7. If your application is approved, the permit will be sent to you (including the conditions under which you will receive the permit);
  8. If you do not agree with the decision, you can appeal. The decision tells you how to do that.

The cost depends on which all-in-one permit for physical aspects you apply for. You must pay even if your application is rejected.

  • Gross floor area till 1000 square: € 1.040,00
  • Gross floor area from 1000 till 5000 square € 2.312,00
  • With a gross floor of  5000 m2: € 4.624,00
  1. If your application is approved, the permit will be sent to you (including the conditions under which you will receive the permit);
  2. If you do not agree with the decision, you can appeal. The decision tells you how to do that.
