Buildings must meet fire safety regulations.

In some cases, you must notify the municipality that you are going to use the building; this is called a notification of fire safety-compliant use (gebruiksmelding brandveilig gebruik) .

You must apply for an all-in-one permit for physical aspects (omgevingsvergunning) for fire safety-compliant use.

You can find out if you need to make a notification by running the permit check on the online service counter Omgevingsloket online (in Dutch).

Environmental permit

You must apply for an environmental permit for fire-safe use of the building when one of the following situations applies:

You offer a business night stay for more than 10 people (such as in hotels and pensions); 

In the context of care, you offer night accommodation to more than 10 people (such as in hospitals and nursing homes); 

There are more than 10 people under the age of 12 staying during the day (such as in primary schools and nurseries); 

During the day more than 10 physically or mentally handicapped persons stay there. 

Usage Notice

You must report the use to the municipality when one of the following situations applies: 

More than 50 people will be present in the building, not being a home (situation sketch and floor plan drawing required); 

There is equality: the building does not meet the requirements of the Occupancy Decree, but the safety is still just as safe due to extra measures; 

It concerns a house in which rooms are rented out (situation sketch and floor plan drawing required).

Notification fire safe use

The notification form must be submitted in writing at least four weeks before the intended start of use. 

The municipality will send you a confirmation of receipt; 

If your application is not complete, you will be notified by the municipality and you will be given the opportunity to provide the missing information. 

If your report has been approved, you will receive a confirmation that you have complied with the reporting obligation. 

Required data

When filling in the application form you will need the following information:

name, address and place of residence of the applicant or authorized representative; 

address and cadastral data of the building; 

what is the use, how many people do you allow in the building, what installations are there?; 

if you have previously applied for a permit or made a notification; 

the file number of that permit or notification; 

situation sketch and a floor plan drawing for each building layer.

Applying or submitting a notification

  1. Go to the online service counter Omgevingsloket online (in Dutch).
  2. Run a permit check to see if you need a permit or if you must submit a notification.
  3. If you need a permit, you can apply for it at once online on the online service counter Omgevingsloket or send in a written application. Log in with DigiD (for individuals) or eHerkenning (for businesses).
  4. If you have to submit a notification, you can do so at once via the online service counter Omgevingsloket. Log in with DigiD (for individuals) or eHerkenning (for businesses).

The cost depends on which all-in-one permit for physical aspects you apply for. You must pay even if your application is rejected.

Fees are charged for an application for an environmental permit for fire-safe use. The costs are € 600.00.

 There are no fees associated with a fire-safe use report

The municipality needs 8 weeks (standard procedure) to assess your application. In some cases it can take 26 weeks (extended procedure), for example if you want to deviate from the zoning plan. The municipality may extend the period once by 6 weeks.

Do you want to object? Then the following rules apply.

  • For a standard all-in-one permit for physical aspects (8 weeks), you must file an objection within 6 weeks after the decision is published. How to do this is stated in the published decision.
  • Does it concern an extended all-in-one permit for physical aspects (26 weeks)? Then it is issued a a draft decision. You can submit your opinion within 6 weeks. After that, a final decision will be made. You can appeal to the district court within 6 weeks.
