Hosting company that has child porn on servers can be fined

What has changed?

Do you work at a hosting company? Hosting companies have to clean their servers of online child sexual abuse images. The harmful images must be deleted and then be made inaccessible to internet users. The measure aims to prevent internet users from accessing this harmful footage.

The responsible regulatory body is the Online Terrorist and Child Pornographic Material Authority (Autoriteit online Terroristisch en Kinderpornografisch Materiaal, ATKM, in Dutch). Hosting companies that do not quickly remove child pornography after a report can be fined. This fine can amount to up to 10% of the company's turnover in case of repeated violations.

The Online Child Pornographic Material (Administrative Law Approach) Act (Wet bestuursrechtelijke aanpak online kinderpornografisch materiaal) has come into force on 1 July 2024.
