Distance selling of cigarettes and cigars banned

What has changed?

Do you sell smoking products from a webshop? The sale of tobacco products and related goods via online channels is banned.

From 1 July 2023, it is prohibited to sell smoking products 'at a distance'. You areno longer allowed to sell these products via a webshop or social media. Nor, for example, via phone, chat, or mail. The Netherlands Food and Consumer Product Safety Authority (NVWA) monitors this ban.

Smoking products are tobacco products or related products. Related products are electronic cigarettes and refill packs/cartridges, with and without nicotine, and herbal products for smoking.

What is distance selling?

Distance selling means that the buyer and seller are not simultaneously present in person at the sale. For example if you sell a product or service to a consumer:

  • online: through a webshop, an app, chat, or social media
  • by telephone
  • by mail order
  • with an order form from a newspaper or magazine

For whom?

  • owners of (web)shops that sell smoking products at a distance
  • manufacturers and importers of smoking products


This change in the Tobacco and smoking products Decree (Tabaks- en rookwarenbesluit) took effect on 1 July 2023.
