Continued payment of wages during illness shortened for AOW employees

This information is provided by Netherlands Enterprise Agency, RVO

Effective date: 1 July 2023

What changes?

Do you employ a state pensioner (AOW or state pension aged employee)? The period you have to continue to pay their wages in case of illness (sick pay) will be shortened to 6 weeks. Currently employers must continue to pay state pensioners for 13 weeks when they are ill. This will be 6 weeks.

This period of 6 weeks will apply from 1 July 2023. For those AOW employees who already were ill on 1 July 2023, the period of 13 weeks sick pay stays valid. For those AOW employees who fall ill on or after 1 July 2023 the 6-week period will apply.

For whom?

When?

This change is expected to come into force on 1 July 2023.

Please note: The effective date of this measure is not yet final. Entry into force is subject to its passing through the upper and lower houses of parliament or proclamation of the Order in Council (Algemene Maatregel van Bestuur, AMvB) or ministerial decree and publication in the Staatsblad or Staatscourant (Government Gazette, in Dutch).
