Telemarketing: no more unsolicited calls to your customers
What changes?
Do you sell products or services by telephone (telesales or telemarketing)? From 1 July 2026 you are no longer allowed to call consumers without their consent, even if they are, or have been your customer. These stricter rules aim to protect consumers from pressure.
The new rules do not apply to:
- charities
- lotteries that donate to charities
- publishers of newspapers, weekly magazines, and other periodicals
Businesses are already only allowed to call consumers if they have agreed (given their consent) or if they are customers. With the removal of this exception for customers, unsolicited calls will be further restricted.
For whom?
- entrepreneurs who use telemarketing for sales
When?
This change in the Telecommunications Act will take effect on 1 July 2026.
Please note: The effective date of this measure is not yet final. Entry into force is subject to its passing through the Lower and Upper Houses (Tweede en Eerste Kamer) of parliament. After publication in the Staatsblad or Staatscourant (Government Gazette, in Dutch) the law can take effect.
