In case of damage caused by earth removal, you can apply for compensation for loss or submit a claim for damages to the province or the state.

Have you suffered damage due to an environment and planning permit for an earth removal or excavation activity? If so, you may be eligible for compensation for loss or claim damages.

Compensation for loss or claiming damages

Did you incur damage because the province or the central government has granted, revoked, or changed an environment and planning permit for earth removal? Then you can apply for compensation for loss resulting from administrative acts or submit a claim for damages to the competent authority.

Conditions for applying for compensation for loss or claiming damages

You can apply for compensation for loss resulting from administrative acts or submit a claim for damages in 1 or more of the following situations:

  • You have applied for an earth removal permit.
  • Your permit that has been revoked or amended.
  • You have expressed your opinion (zienswijze) on an application for an earth removal permit.
  • You suffer damage as a result of another party’s earth removal permit. This includes damage you have had in the past or will have in the future.
  • The damage should not or only partially be your responsibility.

Applying for compensation for loss or claiming damages

Has the province issued the permit? Then you can apply for compensation for loss or claim damages from the province. Has the national government granted the permit? Then you can apply for compensation (in Dutch) or claim damages from the Ministry of Infrastructure and Water Management (IenW).
