Municipality Zutphen: Permit and authorisation for provincial waterway structures

Good to know
You should not start work until you have obtained the permit. If you start before this, you may have to undo the work at your own expense.
With preliminary advice you know whether your plan is feasible
With preliminary advice you know whether your plan, for which you must apply for a permit, is feasible. You don’t have to work out your plan in detail just yet. As of January 1, 2022, there are costs to preliminary advice.
If you request preliminary advice:
- we check whether your plans fit into the zoning plan.
- we will submit your plan to the Spatial Quality and Cultural History Committee. You will then know whether your plan meets the aesthetics requirements. If you have a monument, the committee also examines whether the consequences for the monument are acceptable.
The result of the preliminary advice is a ‘ruling in principle’, a provisional judgement. After this advice, you will know whether you can further develop your plan for applying for the environmental permit.
When applying for the environmental permit, you will be asked to upload attachments. Which attachments are required depends on what you are exactly going to do.
Please note: make sure you have drawings of sufficient architectural quality. If we cannot read the attachments properly, or if sizes are unclear, we will not be able to process your application. This means that it will take longer before you receive a decision on your application.
Examples of attachments are:
- a map on a measurable scale (for example 1:50 or 1:100) of each floor where you are going to build or renovate. Include a description of the use of the spaces in the floor plan.
- longitudinal and cross-sections on the same scale as the floor plans.
- the facade elevations and the height of the structure on the same scale as the floor plans.
- principle details (the data about the appearance of the building) and/or technical details on a measurable scale (e.g. 1:5 or 1:10).
- a description of what the structure will look like (the main features or principle of the construction, including calculations).
- technical information that proves that the structure complies with the latest Building Decree.
After your request
Once your application has been received, we will take the following steps:
- We check whether your application is complete. If your application is not complete, we ask you to submit the missing information.
- We check whether your plan fits within the zoning plan. If your building plan does not fit within the zoning plan, you will need a permit to deviate from the zoning plan. If this has not already been requested by you, we will automatically include this in your application. If you request a preliminary advice, this step is not necessary.
- Does your building plan change the appearance of the building? Then we submit it to the Spatial Quality and Cultural History Committee. The committee checks whether your plan meets the requirements of aesthetics. View the agenda of the committee. If you have a monument, the committee will check whether the consequences for the monument are acceptable. The committee makes a recommendation to the municipality. If you request a preliminary advice, this step is not necessary.
- We check whether the plan complies with other laws and regulations. For example, to the building regulations and the building decree. An assessment based on the Bibob Act may also be required.
- We check whether adjustments to the plan are necessary. If we find that your plan needs to be adjusted, we will let you know.
- We make a decision. Do we approve your plan? You will then receive the decision that the environmental permit has been granted. The application procedure usually takes a maximum of 8 weeks. If it differs, you will be notified.
Permit check + application
- Run the permit check. You will see whether you need a permit.
- You can apply for a permit online or in writing. Log in with DigiD (for individuals) or eHerkenning (for businesses).
The cost of the environmental permit depends on:
- the construction costs (usually this is 2.27% of the construction costs, but always at least €250).
- what exactly you are going to do.
The municipality needs 8 weeks (standard procedure) to assess your application. Sometimes this takes 26 weeks (extended procedure), for example if you want to do something that is not in the zoning plan. The municipality can extend the period once by 6 weeks.

Do you want to object or react? In this case, the following rules apply.
- For a standard all-in-one permit for physical aspects (8 weeks), you must file an objection within 6 weeks of the decision being published. How to do this is stated in the published decision.
- Does it concern an extended all-in-one permit for physical aspects (26 weeks)? Then it is issued a a draft decision. You can submit your opinion within 6 weeks. After that, a final decision will be made. You can appeal to the district court within 6 weeks.
