To place a gaming machine in a catering establishment you must apply for a gaming machine permit, as it pays out money. In Arnhem, this licence is issued for 5 years at once.

No licence is required for the installation of a games of skill machine, as it does not pay out money.

Low-threshold and high-threshold hospitality business

When granting attendance permits for gaming machines, a distinction is made between placement in low-threshold and high-threshold catering establishments. Low-threshold establishments include snack bars, canteens, takeaways and community or youth centres. High-threshold are, for example, pubs and restaurants. A low-threshold catering establishment may not place a gaming machine. A high-threshold catering establishment may place a maximum of 2 gaming machines; these can be 2 gaming machines or 2 games of skill or 1 of both.

Notify changes in writing

Changes, for example in the operation or number of gaming machines, must be reported to the municipality in writing. You may have to apply for a new licence or have your licence changed.

Apply for gaming machine permit

The owner of the gaming machines must hold an operating licence from the Minister of Economic Affairs. A separate licence is required for the machines in a gaming arcade.

You will receive a confirmation of receipt within 1 week. The processing time takes approximately 6 weeks. This period also depends on the possibility of visiting your catering establishment.

If your application is refused, the municipality will notify you early. You can then respond within 2 weeks with an opinion that is taken into account in the final decision. You can object to this final decision within 6 weeks. Do you disagree with the final decision? As an interested party, you can submit a notice of objection within 6 weeks of the date of the decision to the Mayor of Arnhem, PO Box 9029, 6800 ;EL Arnhem.

In addition, in case of urgency, you can ask for an injunction allowing the decision to be suspended. This is only possible if you have also submitted a notice of objection to the municipality. The request for a preliminary injunction must be submitted to the Trade and Industry Appeals Tribunal, PO Box 20021, 2500 EA The Hague.
